I was falsely arrested by the Tempe Police this morning. I guess it's a Happy Valentines Day Present from the jack booted police thugs in the Tempe Police Department. Today is February, 14, 2018

The Tempe pig was T Allen or T Allan, #2210.

And of course I got the usual like of lies and BS from the corrupt police.

When I took the 5th several times and refused to answer this pigs questions he said every time that in this case it's different and I had to answer his questions.

What part of Miranda V Arizona doesn't that pig understand where it says that when a person takes the 5th the police shall immediately cease questioning them.

I'm sure the pig understand Miranda V Arizona, but his real logic is "look muther f*cker, I got a gun and a badge and you ain't got no stinking constitutional rights around me".

Things got worse as they always do.

When I tried to leave I asked the pigs T Allen or T Allan badge #2210 if I was under arrest.

T Allen or T Allan badge #2210, lied to me as pigs always do and say No I was not under arrest.

Of course when I told him, OK, I'm leaving he said I couldn't leave, which meant I was under arrest.

When I told him that if I could not leave I was under arrest, and asked him what his "probable cause" for arresting me was he lied and said he didn't need "probable cause" to arrest me.

He later changed that story to say that he had "reasonable suspicion" to arrest, but, that was also a lie.

I was later released when the pig told me the photos didn't match me.

Of course if he didn't even know what the person in the photos looked like, he didn't have any "reasonable suspicion" to detain me.

This is why we say "f*ck the police" all the time.

Sadly the police are just as bad or worse as the criminals they pretend to protect us from.

More on that false arrest by crooked Tempe Police Officer T Allen yesterday at Burger King.

I want to Burger King last night and asked them what happened to cause my false arrest yesterday morning at 5:39 a.m.

They told me that somebody broke into Burger King at about 3:30 a.m. in the morning.

First Tempe Pig T Allen lied and told me I wasn't under arrest.

then after I exposed that lie, Tempe pig T Allen then gave me a line of BS that he had "reasonable suspicion" to arrest me because of that.

Well if he claims he had "reasonable suspicion" arrest me for a crime that occured about 2 and 1/2 hours earlier because i was in the area that is an outright lie. Looks like Tempe cop T Allen is getting caught in his web of lies.

Of course crooked Tempe Police Officer at first lied and told me he didn't need "probable cause" to arrest me.

Later he change that to say he had "reasonable suspicion" to arrest me.

This morning I talked to the manager of Burger King who reported the burglary to the cops.

He helped me expose more lies that Tempe Police Officer is telling.

He told me that after coming to work and discovering that someone had broken in he left the building. He was afraid the burglars might still be in the restaurant.

I saw him and Tempe Pig T Allen as I walked by the Burger King at about 5:38 a.m. just before Tempe Pig T Allen falsely arrested me.

When T Allen released me from my false arrest he told me that they reviewed the videos at Burger King and I didn't match the description of the burglars.

That was an outright lie by Tempe Police Officer T Allen.

The Burger King manager told me that they didn't even LOOK at the videos until after Tempe Pig, T Allen had falsely arrested me and released me from my false arrest.

He said they didn't even go into the restaurant until after T Allen got back from his questioning of me.

Looks like Tempe Police Officers web of lies about my false arrest are crumbling.

I also talked to the woman who runs the storage place. She says she will get me a copy of the videos from their camera. They have one camera in front, which should have a video of T Allen falsely arresting me.

I also talked to some of the homeless people that were at Burger King when I went their last night.

They said that Tempe piggy T Allen is an *sshole and a liar.

They didn't have to tell me.

I found out from dealing with him yesterday.

More on that false arrest on Valentines Day by Tempe cop T Allen #2210 at Burger King.

After Tempe Police Officer unarrested me, I asked him for his business card, so I would have a name to file a lawsuit against.

The crooked Tempe cop refused and told me that all he was legally required to do was tell me his name. I don't know if he was lying about that.

The crooked Tempe Police officer even refused to give me a pencil or pen so I could right his name down.

Now after I was unarrested, Tempe pig T Allen went back to continue taking a report on the burglary at Burger King.

I suspect Tempe cop T Allen gave the manager of Burger King his business card and told him to call him any time if he needed help.

When I was first falsely arrested and crooked Tempe Police Officer T Allen #2210 started to question me I took the 5th Amendment and told him I wasn't going to talk to him.

Like most crooked cops instead of honoring my 5th Amendment right and ceasing to question me, Tempe Pig T Allen told me several times that I had to answer his questions.

Miranda V Arizona which is the text book case on the 5th says something like when a person takes the 5th the police shall immediately cease questioning the persons.

I guess Tempe Police Officer T Allen #2210 thinks he is above the law because he has a gun an a badge.

Oddly all the the accused rapist on the Tempe City Council seem to think it's OK for them to take the 5th and refuse to answer police question.

Tempe Mayor Mark Mitchell when he was accused of raping a young woman took the 5th and refused to talk to the Phoenix Police about it.

I suspect that Tempe City Councilman Kolby Granville will also take the 5th when he is questioned about charges of raping his students at the school he was recently fired from.

Tempe City Councilman Kolby Granville is also accused of giving the underaged woman liquor. I suspect he will also take the 5th on that.

I suspect it's one of those things that the rulers of Tempe feel the Bill of Rights only applies to them, and not us serfs.

Here is the article about how Tempe Mayor Mark Mitchell, who was at the time Tempe City Councilman Mark Mitchell took the 5th and refused to talk to the Phoenix Police about a rape he was accused of committing.

Report: Mark Mitchell declines police queries on decades-old claim

by Dianna M. Náñez - May. 15, 2012 09:41 PM

The Republic | azcentral.com

In an interview with Phoenix police last week, Mark Mitchell declined to answer questions about decades-old sexual-abuse allegations but did give a statement denying them, according to a police report released Tuesday.

The report was released the same day voters went to the polls to elect Mitchell or opponent Michael Monti as Tempe's new mayor.

Mitchell, a three-term councilman and vice president of a Tempe flooring company, has spent the past week combating the allegations, which he has called false and a "vile" political ploy to destroy his reputation and cost him the election.

"I've been clear, I've done nothing wrong. Not now and not 30 years ago when I was a boy," he said in a statement and video to voters posted last weekend on his campaign website. "But I'm sending this because you deserve to know the truth from me personally. Just as Tempe deserves a race for mayor based not on personal attacks, but on the issues."

Monti, a longtime downtown Tempe restaurateur, also issued a statement last Thursday lashing out at Mitchell for tying him and his campaign to the allegations.

"I did not wish to comment on this, but I am forced to because Mr. Mitchell is actually trying to blame our issues-based campaign for this chain of events," he said. "Neither I nor anyone associated with my campaign had anything to do with the criminal investigation of Mr. Mitchell."

Earlier this month, police referred their investigation into the allegations to prosecutors with recommended felony charges, but said they made no arrest due to the length of time that has passed since the alleged offense, and the ages of those involved at the time.

Police tried for weeks to schedule an interview with Mitchell. Mitchell's attorneys ultimately scheduled the interview for last Monday after police informed them on April 30 that the case could be referred to prosecutors without his statement. Despite securing a date for the interview, police referred their findings absent Mitchell's statement to the Maricopa County Attorney's Office.

Maricopa County Attorney Bill Montgomery, who has endorsed Monti, recused himself from the investigation and turned it over to Yavapai County Attorney Sheila Polk.

Yavapai officials said they expect to finish reviewing the investigation by June. Phoenix police have referred Mitchell's interview to Yavapai.

The allegations surfaced in February, one month before Tempe's March primary, from a 39-year-old Tempe woman whose name was redacted from the public record.

She told police the abuse occurred four times in 1983 when she was 10 and Mitchell was about 16. Mitchell, 42, would have been no older than 14 in 1983.

Investigators secretly recorded an April 5 conversation between the alleged victim and Mitchell. According to police reports, Mitchell apologized to her and said that they were young and experimenting and that he never meant to hurt her.

This is the final version of what happened. I till need to add the stuff on what happened before I got to Burger King.

The full story on my false arrest on Valentine's Day, February 14, 2018 by crooked Tempe Police Office T Allen, #2210.

I was stopped by Tempe Police Officer T Allen at about 5:48 a.m. after I was walking thru the parking lot at Burger King.

He told me something like he wanted to ask me some questions.

I invoked my 5th Amendment rights and told him

"I don't talk to people.".
That's a polite way of saying
"I don't talk to police thugs who want to integrate and find a lame excuse to put me in jail"
Like most police criminals Officer T Allen seem to think he is above the law, and above the 5th Amendment and he told me something like
"You have to talk to me in this case. Somebody broke a window and broke into Burger King."
From that statement it's pretty obvious that Officer T Allen wasn't a gay cop who wanted to invite me to the Gay Policeman's Ball, but a cop who wanted to question me about a crime and find a lame excuse to arrest me for it.

It was also pretty obvious that Tempe Police Officer T Allen was violating my 5th Amendment rights after I told him

"I don't talk to people"
I haven't read Miranda V Arizona in a few years but it says something like
when a person makes a request to remain silent, the police shall immediately cease questioning the person.
Again I told crooked Tempe Police Officer T Allen that I wanted to remain silent by again saying
"I don't talk to people"
I don't think Officer T Allen is a stupid moron and didn't understand me. Nor do I think Officer T Allen is a stupid moron who doesn't understand the 5th Amendment. I think Officer T Allen is a crooked cop who wants to violate my civil rights and extort a confession out of me.

The conversation went on several times with Officer T Allen telling me I had to talk to him, and me continuing my matra of telling him I am taking the 5th by saying

"I don't talk to people"
Officer T Allen also asked me for my ID, despite the fact I had told him several times
"I don't talk to people"
Again violating my 5th Amendment rights.

Finally wanting to leave the police criminal I asked Officer T Allen #2210,

"Am I under arrest".
Officer T Allen again lied to me and told me:
No you are not under arrest.
So I told Officer T Allen
"OK, I'm leaving, bye"
Officer T Allen then admitted his lie and told me that I could not leave. I think he told me something like;
I was under investigation custody and I could not leave.
I then told Officer T Allen that if I was under investigative custody, that I was under arrest, because the legal definition of arrest is when you are detained by the police and NOT free to go.

At this point in time Officer T Allen has just violated my 4th Amendment rights by falsely arresting me without the required "probable cause" or "reasonable suspicion"

I then asked Officer T Allen what his "probable cause" was for arresting me.

Officer T Allen then lied to me again and said he didn't need "probable cause" to arrest me.

Office T Allen also told me that my legal knowledge was wrong and I didn't know what I was talking about.

At that point in time Officer T Allen made me sit down on the sidewalk.

After sitting on the sidewalk for a while I decided to wake up Tara and complain to her that the Tempe pigs were falsely arresting me, and violating my civil rights on her property.

Officer T Allen, told me to sit down and would not let me wake up Tara.

Finally at about 5:58 Officer T Allen started looking at his phone, and he eventually lied to me and told me the video tapes had been reviewed and I was not on them so he was releasing me.

At about that time a second Tempe Police Officer came by and became an accessory to Officer T Allens crime of violating my civil rights. She was a female cop.

I asked Officer T Allen for his name and business card.

He gave me his name and badge number, which he claimed to be #2210.

He told me he didn't have to give me his business card.

Personally I think Officer T Allen is a real *sshole. I'm 99.9999% sure that he gave the manager of Burger King his business card after finishing up taking the reports on the burglary of Burger King.

But police criminal T Allen refused to give me his business card so I could have an easy way to identify him and file a lawsuit against him.

At about 5:30 pm or 6 pm that day, I went back to the Burger King and talked to the employees on the evening or night shift.

They told me that somebody did break into Burger King that morning. They said they broke a window at 3:30 a.m.

That's the first solid evidence I had that Officer T Allen falsely arrested me. And violated my 4th Amendment rights in addition to my 5th and 14th Amendment rights.

If the burglary occurred at 3:30 a.m., there is no way that Officer T Allen would have either "probable cause" or "reasonable suspicion" to arrest me almost two and one half hours later at 5:48 a.m.

The next day at about 6:15 a.m. in the morning I went and talked to the manager of the Burger King. It's the same manager that reported the burglary to the police the day before.

He was also present when the cop falsely arrested me.

He told me that when he got to work he noticed the burglary and quickly left the building, because he thought the burglars might be inside.

And of course that's the second solid evidence I had that Officer T Allen falsely arrested me.

The manager didn't even go back into the building until after Officer T Allen had falsely arrested me and released me from my false arrest.

That means Officer T Allen lied to me about them reviewing the video tapes and me not being on them. The video tapes were NOT reviewed at that point in time.

They did not review the videotapes until AFTER I was released from my false arrest.

And of course if they had not viewed the videotapes they didn't know what the suspect(s) looked like. So again Officer T Allen didn't have either the required "probable cause" or "reasonable suspicion" to arrest me.

And thus my arrest was a false arrest.

The good news is Tara said she would give me the video tapes from her business, which I think will show the cop with me under arrest.

More good news is there was also one witness who saw me under arrest. He is also in the videos.

This is what happened before the arrest.

I caught the northbound 56 bus at about 4:57 a.m. just north of Baseline Road, across from Arizona Mills Mall.

I got off at Broadway and Priest.

I went to Circle K and got my 44 ounces of Mountain Dew. Alex the Najavo guy sold it to me. Should be videos here too.

I went to Jack in the Box and took a pee. Should be videos here too.

I screwed up and peed on the floor, so I cleaned it up.

I then went to McDonalds and took a 2nd pee. Should be videos here too.

I watched TV from the outside of McDonalds for a while.

I went to the lockers and got there at maybe 5:30.

Had to poop, so at about 5:39 I went back to McDonalds.

Walked passed Burger King and saw the piggie (T Allen #1120) and the manager of Burger King out side.

I kinda thought he was a pig but wasn't thure so I said hi.

I went to the lockers and got there at about 5:48.

And that's when I got questions by the piggie as he walked over from Burger King.

Another claim for damages from the false arrest by Tempe Police Officer and criminal T Allen #2210

As you know, on Valentines Day, Feb 14, 2018 at about 5:48 a.m. I was falsely arrested by Tempe Police criminal and terrorist T Allen, badge #2210. I was arrested near the Burger King on Broadway Road, just east of Priest Drive in Tempe.

After Tempe police terrorist T Allen released me from my false arrest, I asked him for his business card. That way I would have a name, title printed on a business card to file my civil rights and false arrest lawsuit in Federal Court.

Tempe police officer and criminal T Allen told me all he was required to do was verbally tell me his name. He said he was required to do nothing more.

And in fact he refused my request to give me a pencil and paper so I could write his name down.

Also he refused to tell me his name more then once.

I suspect that after Tempe Police terrorist and criminal went back to the Burger King to take the reports on the burglary there, he gave the manager of Burger King his business card, and told him to give him a call if he had any more questions or concerns.

If you ask me that sounds like I may have a second claim against the city of Tempe and Tempe Police criminal T Allen for violating my 14th Amendment rights under the US Constitution and violating the "Equal Protection" clause in the Arizona Constitution.

If the Tempe Police criminals give their business cards to people that have been victims of crimes by committed by common criminals, they certainly should also give their business cards to people that have been victims of crimes committed by police criminals.

So I would like to file an addition claim for damages against the city of Tempe for crimes committed to me by Tempe police criminal T Allen for an additional $100 million, because he refused to give me his business card.

the lady I talk to at Jack in the Box told me that.

So if I need to hunt him down for a subpoena, that's where he will be at

Here is a copy of the lawsuit I filed in Federal Court on March 8, 2018 suing Tempe Police Officer T Allen and an unnamed female Tempe Police officer.

In Federal court it is pretty easy to issue subpoenas to get data and information in a false arrest lawsuit.

Here is the one form you fill out.

After filling it out the court stamps it and bingo, you got your subpoena.

5. Defendant #2 is an unknown woman believed to be a resident of the State of Arizona and believed to be a Police Officer for the city of Tempe, Arizona.

III. GENERAL STATEMENT

6. On Wednesday February 14, 2018 at about 3:30 a.m., the Burger King at 1139 W. Broadway Road in Tempe was broken into, according to Burger King employees the Plaintiff spoke to.

7. Sometime around 5:30 a.m. The burglary was discovered by Burger King manager Ramon, and the Tempe Police were called.

8. Around 5:48 a.m. about 2 and ½ hours after the burglary the Plaintiff walked by the Burger King restaurant.

9. The Plaintiff said “hi” to BK manager Ramon and Defendant #1.

10. BK manager Ramon told Defendant #1, that the Plaintiff uses the restroom every morning and probably was not the burglar.

11. Defendant #1 followed the Plaintiff to Extra Space Storage.

12. Defendant#1 began to question the Plaintiff.

13. The Plaintiff as he always does took the 5th Amendment and told Defendant #1, and said something like “I don't talk to people”.

14. Defendant #1, was not there on private, personal business to ask the Plaintiff to go to the *** policeman's ball on a ********** date, but was there on Tempe Police business to investigate the burglary. Defendant #1 should have known that the Plaintiff was taking the 5th Amendment and demanding his right to remain silent.

15. Instead of immediately ceasing to question the Plaintiff, Defendant #1, violated the Plaintiff's 5th Amendment rights by telling the Plaintiff something like “this is different, you have to talk to me”.

16. The Plaintiff responded, like a broken record player again with something like “I don't talk to people”. Again telling Defendant #1, he wanted the Tempe Police to honor the Plaintiff's 5th Amendment right to remain silent.

17. Again Defendant #1 violated the Plaintiff's 5th Amendment rights and told the Plaintiff something like “this is different, you have to talk to me”.

18. This cycle was repeated several times, with Defendant #1, violating the Plaintiff's 5th Amendment rights each time.

19. Next Defendant #1 again violated the Plaintiff's 5th Amendment rights by ordering him to give Defendant #1, identification.

20. The Plaintiff again said something like “I don't talk to people” again telling Defendant #1, he wanted the Tempe Police to honor his 5th Amendment right to remain silent.

21. Again Defendant #1 violated the Plaintiff’s 5th Amendment rights by saying something like “this is different, you have to”.

22. Finally the Plaintiff got tired of having his Constitutional rights violated by Defendant #1, and decided to leave.

23. The Plaintiff asked Defendant #1, if he was under arrest.

24. Defendant #1 lied to the Plaintiff and told the Plaintiff he was NOT under arrest.

25. The Plaintiff then said something like, “I'm leaving. Bye”.

26. Defendant #1, then admitted his lie, and told the Plaintiff that he was under arrest, and could not leave. Defendant #1 told the Plaintiff something like he was under investigative custody and could not leave. At this point Defendant #1 had falsely arrested the Plaintiff and also was violating his 4th Amendment rights.

27. At this point in time Defendant #1 did not have either “probable cause” or “reasonable suspicion” to arrest the Plaintiff.

28. The Plaintiff told Defendant #1, that he was under arrest, if he was being detained by the police and not free to leave. The Plaintiff told Defendant #1, that he needed “probable cause” to arrest the Plaintiff.

29. Defendant #1, lied again, and told the Plaintiff he did not need “probable cause” to arrest the Plaintiff.

30. Defendant #1 ordered the Plaintiff to sit down on the side walk.

31. Around this time Defendant #1, again lied and told the Plaintiff that his legal logic was wrong. The Plaintiff thinks this lie by Defendant #1, was a feeble attempt to coercer the Plaintiff into giving up his 5th Amendment rights and answer Defendant #1 questions.

32. Defendant #1 later lied again and claimed he had “reasonable suspicion” to arrest the Plaintiff, but did not tell the Plaintiff, what the “reasonable suspicion” was. Again the Plaintiff thinks this lie by Defendant #1, was a feeble attempt to convince the Plaintiff to give up his rights, and convince the Plaintiff he was not being falsely arrested.

33. After a while the Plaintiff decided to wake up the manager of Extra Space Storage and see if she could help stop the Plaintiff's false arrest. The Plaintiff got up and started to walk toward the door of the manager’s apartment.

34. But Defendant #1 ordered the Plaintiff to sit back down, and prevented the Plaintiff from getting help to stop the false arrest and civil rights violations, and violating the Plaintiff’s 1st Amendment rights.

35. Around 5:57 a.m. or so Defendant #1 started looking at his cell phones or other electronic devices.

36. At about the same time Defendant #2 walked from Burger King to Extra Space where the Plaintiff had been falsely arrested.

37. Defendant #1 told the Plaintiff that he was free to go and no longer under arrest. Defendant #1 lied said something to the effect that somebody had viewed the videos and that the Plaintiff was not in them.

38. If the videos had never been viewed, that means nobody knew what the suspects looked like. Which means Defendant #1, didn’t have either “probable cause” or “reasonable suspicion” to arrest the Plaintiff. And that the Plaintiff’s 4th Amendment rights had been violated.

39. The Plaintiff asked Defendant #1 for his name and business card.

40. Defendant #1 refused to give the Plaintiff his business card saying all he had to do was tell the Plaintiff his name. This was a violation of the Equal Protection clause in the 14th Amendment and in the Arizona Constitution.

41. Defendant #1 and Defendant #2 then went back to Burger King to respond to the burglary.

42. The next day, when the Plaintiff talked to BK manager Ramon the Plaintiff discovered that Defendant #1, had lied about the viewing the video tapes of the break in.

43. BK manager Ramon said something to the effect that they had not entered the restaurant until after the Plaintiff was released, because they were afraid the burglars might still be in it.

44. Thus, the video tapes had not been viewed until after the Plaintiff had been released from his false arrest. And that Defendant #1 had lied when he told the Plaintiff that the viewing of the video tapes cleared him. And that Defendant #1 did not have “probable cause” or “reasonable suspicion” to arrest the Plaintiff.

VII. FOURTH CAUSE OF ACTION

Fifth Amendment violations

53. The Plaintiff incorporates by reference the allegations contained in paragraphs 13 through 21 of this complaint as if fully set forth herein.

Here is the blurb on when my lawsuit was accepted and the URL

Good news, the Federal Court approved my lawsuit against Tempe cop T Allen who falsely arrested me on Valentines Day, Feb 14, 2018.

They only disapproved two items. One they told me I could not sue the unnamed female cop who showed up in the last minute during the arrest.

Unknown Police Officer – Defendant #2

...

5. Defendant #2 is an unknown woman believed to be a resident of the State of Arizona and believed to be a Police Officer for the city of Tempe, Arizona.

They didn't dismiss that with prejudice, so I suspect once I get her name I can amend the lawsuit and add her back in.

They also dismissed the item where I asked the cops to be charged with attempted armed robbery for demanding my ID, after I took the 5th.

VIII. FIFTH CAUSE OF ACTION

Attempted Robbery and Attempted Armed Robbery

56. The Plaintiff incorporates by reference the allegations contained in paragraphs 19 through 21 of this complaint as if fully set forth herein.

57. Defendant #1 armed with a gun, attempted to coerce the Plaintiff’s identification from him with a verbal threat, that is considered attempted robbery which is a felony under A.R.S. 13 §§ 1901-1902.

58. Attempted Armed Robbery per A.R.S. 13-1904, a felony, occurred because Defendant #1 had a handgun.

They said this was a civil lawsuit and I could not ask the cop to be charged with criminal items.

While I figured hell would freeze over before that happened it was fun to put in in the lawsuit.

Also they are going to serve Tempe Police Officer T Allen for me with the US Marshals. I I think they will first asked him to accept a copy of the lawsuit via mail, and then if he refuses use the US Marshals to serve him.

So I don't need anybody's help to serve the cop.

Here is a link to the pages of the lawsuit which I scanned and uploaded to Facebook.

A friend mentioned that I could get the metadata with subpoensas with the case:

Lake V Phoenix
He said that is an Arizona case that went to the Arizona Supreme Court and that per Lake v Phoenix, they have to give you meta data if you request it.
