I'm filing a Title 42 Section 1983 civil rights lawsuit against Valley Metro and the City of Tempe in Federal court for when their light rail cops refused to let me video tape them and chased me off of the light rail platform on 3rd Street & Mill.

I saw a guy passed out on the platform and when the cops came I started videotaping them. The cops chased me off the platform and told me it was illegal for me to videotape them.

I called Valley Metro Risk Management [ (602)459-8250 ] and asked them where I could serve them with a copy of the lawsuit.

Instead of the *ssholes telling me the address of their legal department they gave me the run around and told me to call the Arizona Corporation Commission.

Normally when you file a lawsuit against a corporation, you serve the papers to the statutory agent. And of course the address of the statutory agent is on file with the Arizona Corporation Commission.

But the *ssholes at Valley Metro didn't tell me any of those details, they just told me to call the Corporation Commission.

I suspect those government *ssholes are trained to make life as difficult as possible for people they f*ck over.

After getting the run around on that I just told the person who answered the Valley Metro Risk Management phone that I wanted the address of the Valley Metro legal department so I could serve them with the papers.

They then stopped giving me the run around and gave me the address which is:

Suite 1300
101 N 1st Avenue
Phoenix, Arizona
85003
Valley Metro is a royal pain in the *ss to deal with. Prior to the call with the Valley Metro Risk Management group which gave me the runaround I had a phone call with the normal Valley Metro line (602) 253-5000 and it too them 15 minutes to find the number of the risk management department.

The first time around and after 15 minutes on the phone the *ssholes gave me the wrong number.

I only spent 5 more minutes on the phone when I called them back a second time to get the correct number.

Last time I filed a lawsuit against the city of Tempe I had the US Marshals deliver copies of the lawsuit to the Tempe piggies I was suing.

I think that kind of freaked out the piggies because I located their home addresses and had the US Marshals serve them at their homes.

After I did that the Tempe City attorney told me that I could just have my process server deliver copies of any lawsuits to the city attorney's office and they would accept them. I think that was Allen Chen, who is now the Tempe City Manager.

I just called the Tempe City Attorney's office and apparently they have changed their minds on that and are going to make life as difficult as possible for people suing the city of Tempe. There number is (480)350-8227.

The woman I spoke to there was a real jerk. She told me the Tempe City Attorney's Office would not accept service of the lawsuit for anybody.

She told me that if I was serving the city of Tempe, I had to send my process service to the City Clerks office. Even thought the Tempe City Attorney will defend the city in the lawsuit.

She told me that if I was serving the members of the Tempe City Council, I had to send my process service to the City Clerks office and serve the members of the Tempe City Council there. Even thought the Tempe City Attorney will defend the city in the lawsuit.

The members of the Tempe City Council that will be use in this Title 42, Section 1983 Civil Rights lawsuit are: Mark Mitchell, Robin Arredondo-Savage, Kolby Granville, Randy Keating, Lauren Kuby, Joel Navarro and David Schapira.

So now I have to figure out what I want to do. I can get the home addresses of all the Tempe City Council members, list them on the lawsuit and serve them at home. And since I will post copies of the lawsuit on Facebook and numerous listservers, their home addresses will be viewable by the entire planet.

Or I can serve them at a Tempe City Council meeting. I think it would be nice to serve those jerks while they are conducting a Tempe City Council meeting.

The reason I am suing all the members of the Tempe City Council in the lawsuit is because they never responded to my request for public records for the names of the cops that violated my civil rights.

Nor did they respond to my request for public records for the name of the rent-a-pig company that supplies the cops to Valley Metro and the City of Tempe.

I have also named Valley Metro in the lawsuit. They gave me the run around when I called them asking for where I can serve them.

I will be suing the city of Tempe and Valley Metro because I was videotaping 3 Valley Metro rent-a-cops who seem to be harassing a man who had passed out on the Valley Metro light rail platform on 3rd Street & Mill in Tempe.

The Valley Metro rent-a-pigs give me a line of BS that it was illegal to video tape them unless I had their permission and then chased me off the light rail platform.

After they told me I could not videotape them they then demanded my bus pass.

Back then I used to have a monthly bus pass and because they seemed mostly interested in stopping my videotaping I didn't give them the pass because I was afraid they would steal it from me and then arrest me for not having a pass.

Anyhow a copy of the video is here: https://www.youtube.com/watch?v=0-NcaK599Fs

For the record the US Supreme Court has said a number of time that people have the RIGHT to videotape the police.

I will probably file the lawsuit in the next couple of days and then work out the serving process. Under Federal law, anybody who is not a Plaintiff in the lawsuit (i.e. me) can serve the Defendants in the lawsuit with their copy of the lawsuit.

You have to deliver a copy of the lawsuit to the person being served. And then fill out a form saying that you gave the person a copy of the lawsuit.
