When me, Alex, and Dave wrote the initiative Safer Arizona initiative we didn't allow them to write zoning laws that were aimed at marijuana users or businesses. Because we knew they would add sever restrictions to terrorize marijuana users.

We said that marijuana businesses would have to obey existing zoning laws, but the government could not pass laws aimed at marijuana businesses.

Marijuana criminal defense attorney then came along and changed the initiative and watered it down by adding numerous restrictions against marijuana users and businesses such as the above zoning blurb.

Robert W. Clark called me a liar for saying the Safer Arizona initiative would allow city and county government to pass zoning laws that require marijuana businesses to be a mile a part, like the zoning law Chander wrote requiring medical marijuana businesses to be a mile a part.

Robert W. Clark didn't mention that Tom Dean added a blurb to the Safer Arizona initiative that requires marijuana businesses to be 1,000 feet from schools. That blurb acts as a zoning restriction.

Based on that blurb in the current Safer Arizona initiative, I'm sure the courts would rule that a zoning law requiring recreational marijuana businesses to be 1 mile apart would be held as a reasonable zoning law.

I suspect cities and counties could also pass zoning laws requiring marijuana businesses to be 1,000 feet from churches, day care centers and other businesses and the courts would rule that it is also a reasonable law.

Here in Tempe, they passed zoning laws that require medical marijuana businesses to be in industrial areas.

I suspect that if cities and counties passed zoning laws requiring recreational marijuana stores to be in industrial areas, like the did for medical marijuana businesses, the courts would rule it is a reasonable zoning restriction.

Tempe has also passed draconian zoning laws limiting the hours of medical marijuana dispensaries. I think they are only allowed to operate from something like 8 a.m to 7:30 p.m.

I'm sure that if cities and counties passed zoning restrictions that limited recreational marijuana stores to the same hours, the courts would rule they are "reasonable" zoning restrictions. Like the Tempe zoning law on medical marijuana dispensaries.

Tempe has also passed draconian zoning laws that required medical marijuana dispensaries to videotape their customers.

I'm sure that if cities and counties passed draconian zoning laws that required recreational marijuana stores to videotape their customers, the courts would rule that they are reasonable zoning restrictions. Like the Tempe zoning law on medical marijuana dispensaries.

I was kicked off of the Safer Arizona board of directors for complaining that Tom Dean was turning the Safer Arizona initiative into a mini versions of Prop 205. And my initial complaints were pretty much pointing out the same problems I am pointing out now.

Yes, I would say, vote for the Safer Arizona initiative. It's not as bad as Prop 205, but it has a lot of serious problems.
